How the check works

Law 5303/2026 applies to deaths from 16 September 2026. This tool is informational and does not replace a lawyer or notary.

The new rule separates the heir’s personal assets from estate obligations. Personal liability may arise after a court declaration of free management or a disposal of estate assets contrary to Article 1895. Judicial liquidation is a separate procedure that can keep the estate separate.

Renunciation is generally due within four months after learning that the inheritance devolved to you and the reason. The period is one year if the deceased had their last residence abroad or you lived abroad when the period began. For a will, the period cannot start before publication.
